Conceived on 1977, iBOOKS has come a long way in pursuance of the Most Powerful Topper Producing Learning System.
This is an agreement containing all terms and conditions that are agreed to between iBOOKS Institute Pvt. Ltd. and / or iBOOKS College Pvt. Ltd., as appropriately stated on the overleaf of this application form with head office at New Delhi, henceforth called iBOOKS, the applicant and his / her parent / guardian as mentioned in the application form overleaf.
The application form given overleaf forms an integral part of this agreement.
This shall remain effective from the date of admission till the end of the course in which the student is enrolled.
Topics and / or headings wherever mentioned herein are only indicative and the detailed clause shall have to be read for all purposes.
SECTION - I : GENERAL RULES / DISCIPLINE
DISCIPLINE
Absolute discipline is to be maintained within the premises of iBOOKS. No student is permitted to represent any other student for any matter whatsoever. Any student trying to do so will asked to discontinue from the course.
iBOOKS targets itself only to academic activities. Thus it does not undertake any other responsibility, including any occurrence outside its premises involving the student.
Parking of vehicles :
Students are not permitted to come to iBOOKS by four wheelers and park it in / around the premises of iBOOKS (except when accompanied by parents).
Safe parking of cycle / two wheelers / vehicle is the absolute responsibility of the student himself / herself.
iBOOKS will not be in any way responsible for any theft/loss/damage of/to cycles/two wheelers/vehicles from inside or outside the premises of iBOOKS.
Students coming by two wheeler to iBOOKS have to compulsorily use helmet.
Students are not permitted to use Mobile inside the premises of iBOOKS.
iBOOKS reserves right to the following without assigning any reason
To refuse admission to any candidate.
If so, the fee (including the non-refundable registration fee), already paid by the student if any, will be refunded without interest by cheque.
To cancel studentship at any point of time of coaching.
If so, the residual fee calculated on pro-rata basis (this fee does not include the non-refundable registration fee), already paid by the student if any, will be refunded without interest by cheque.
To regroup the student(s) at any point of time of coaching.
To change class timing at any point of time of coaching.
To change class/subject teacher(s) at any point of time of coaching.
To change the venue of classes to any place within the city / town limits / 25 km radius.
To use, for publicity or otherwise, any information (including applicant’s photograph) provided by the applicant through this application form, in anyway as necessary for any company of BOOKS Group of Companies.
To frame new rules to be followed by the students.
To add / delete / modify any or all portion of the syllabus of study during the tenure of the coaching period.
To refuse discussion about anything related to the student with anyone except the student and the parent / guardian who sign this application. No power of attorney or authorisation in favour of any other person or representative of the student and/or the parent/guardian shall be entertained in any case.
To discontinue anytime a course (of one or more students) at its sole discretion, in which case there shall be a refund of fee paid in advance (i.e. OTP) in accordance with the refund policy stated below under SECTION-II. Note that IPS/EMI not being an advance payment, do not qualify for refund.
Hostels & Transport :
At some branches iBOOKS has its own hostels and transport facility for which a separate form is to be filled up.
At other places, wherever possible, iBOOKS has registered Hostels and Transport Owners. They give Hostel and/or Transport facilities to specifically the iBOOKS students. The Transports usually pick up students from the nearest specified pick-up points and not from home. They have their own rules and regulations. However iBOOKS exercises very limited control over them.
However generally, iBOOKS aims to dedicate itself to academics only. So all the above facilities are arranged from that perspective alone.
Laptops / Mobiles : In courses where a laptop/mobile are provided, the same shall be the property of iBOOKS till the end of the course. It shall be governed by the following additional rules:
It will lent to the student for use till the end of the course.
On completion of the course and completion of payment of full fees, whichever is later, the student must apply to the Chairman, iBOOKS for transfer of ownership.
If the above application is approved by the Chairman, iBOOKS then the ownership of the laptop/mobile shall be transferred to the student.
In case the above application is not approved by the Chairman, iBOOKS then the laptop/mobile shall have to be returned to iBOOKS.
SECTION - II : COURSE FEE, Discounts & Scholarships details
The student, taking admission, under IPS or OTP schemes (Specified below) has to pay a one time administrative non-refundable expense called REGISTRATION FEE as a part of the course fee in the beginning. This is an expense incurred by iBOOKS within the first 5 days of admission.
Three schemes of payment of course fees are available : One Time Payment, henceforth referred to as OTP, Instalment Payment Scheme, henceforth referred to as IPS and Equal Monthly Instalments, henceforth referred to as EMI.
Option of payment schemes (OTP or IPS or EMI), must be exercised at the time of admission.
Conversion from IPS/EMI to OTP is possible, before the due date of the second instalment with payment of additional conversion fee of Rs500/- (service tax extra).
In such cases final amount payable at the time of such conversion will be equal to [total OTP fee of cheque mode - actual amount paid in first instalment + Rs 500/- ( service tax extra)].
Conversion from IPS/EMI to OTP after due date of second instalment is subject to permission by iBOOKS on a case to case basis.
A written application shall have to be made by the applicant and/or his/her parent/guardian for this.
In such cases the conversion fee shall be proportional to the delay in converting to OTP. The conversion fee shall be equal to Rs1000/- (service tax extra) per instalment already due in IPS scheme till the date of receipt of application at iBOOKS.
The student and the parent/guardian opting for schemes other than EMI know very well that by doing so they are foregoing the option to receive any proportional refund, should they decide to discontinue from the course at any time during the course period.
In case of revision/imposition of service and/or other taxes, at a later date, leviable to the student by the Central/State Government or other regulatory bodies / agencies, the same will be borne additionally by the student, after such announcement. In case of OTP (along with Registration fees) also the proportionate extra amount, if any, to be paid to the Central/State Government or other regulatory bodies / agencies, arising out of such imposition/revision of service and/or other taxes, is to be paid by the student to iBOOKS within the stipulated time period.
In case of OTP :
Refund is permitted on permanent discontinuation of course (including cancellation of studentship as per clause given earlier in this agreement). For refund, the student has to fill up “Application For Refund” (AFR) subject to the clause about KPS given in this agreement.
Amount Refundable in OTP scheme : Refund amount = (OTP amount actually paid by student after discounts, if any) – (Total amount of installments payable under IPS/EMI , till and including the month in which “Application For Refund” is made) – (KPS already paid, if any) – Non-refundable Registration fee.
In case of IPS / EMI :
In case of a student, paying fees by IPS/EMI, wishes to permanently discontinue from the course, he/she must do all of the following:
Apply in writing to iBooks (signature of parent/guardian is also required on the same).
Pay all instalments including the instalment of the month in which he/she makes such an application.
Return back to iBOOKS all the scholarship received till that date.
Note that the instalments are not Monthly tuition fees. The only purpose of Instalment Payment Scheme (IPS) or Equal Monthly Instalments (EMI) is to make the course-fee payment easy for the student. Thus all the instalments are to be paid even if the student absents, for any duration and for any reason whatsoever, during the course period or even absents/discontinues or fails to take action as per the clause given above.
The due date of the instalments is anytime on or before 6th of the corresponding month except in case of last instalment where it shall be on or before 1st of the month.
Delay in payment of instalments : A maximum delay of 10 days in the payment of instalment is permissible with late fees of Rs 20/- per day. In case of the last instalment this allowable delay shall be only 3 days. After this period, the name of the student will be struck off rolls and shall amount to permanent discontinuation of the student from the course.
Re-registration : Re-registration is not permitted. However upon written application, the Chairman of iBOOKS, at his absolute discretion, may permit re-registration on payment of “Re-registration fee” of Rs 500/- +Service Tax along with the previous outstanding instalments.
An installment, once paid under IPS / EMI scheme, isNOT refundable except when a student is refused admission as per clauses given in this agreement.
No instalment can be paid more than 30 days in advance.
Scholarships :
iBOOKS may frame rules for payment of scholarship to students from time to time.
This scholarship is currently referred to as KPS, wherever mentioned in this agreement.
Students who complete the course are alone eligible for scholarships.
Payment of scholarship shall be at the sole discretion of iBOOKS.
Scholarship (KPS) is given by iBOOKS at its own initiative and out of its own fund. Thus KPS rules and its continuity are at the absolute discretion of iBOOKS. In case of any confusion as regards Kashi Padma Scholarship (KPS), the decision of the Chairman of iBOOKS shall be final.
Any applicant and/or his/her parent/guardian cannot claim payment of KPS from iBooks under any circumstance.
Discounts :
All discounts are available to students who complete the course.
Students opting for EMI shall be eligible only for Merit Discount and other discounts like Special Discount from Head Office shall not be applicable to them.
In case of IPS/EMI, all discounts, if any, shall be adjusted from the last instalments.
In case of OTP all discounts, if any, shall be adjusted at the time of payment of OTP fees.
Whenever a student is eligible for more than one discount, only one discount, whichever is highest, will be applicable.
Section - III : PAYMENT MODE
All payments are to be done through authorisation / online payment / ECS / Direct Debit mendate / local MICR cheque / DD / Credit or Debit card only.
All cheques / DD must be drawn in favour of iBOOKS Institute Pvt. Ltd. or iBOOKS College Pvt. Ltd, as appropriately stated above, payable at a city where a branch of iBOOKS is situated which are presently, New Delhi, Bhubaneswar, Berhampur, Cuttack, Rourkela & Sambalpur only.
Cash payment is permissible, only in case of installments, by paying an additional payment of cash handling charge of Rs1,000/- for each transaction.
If a cheque / DD is dishonoured, for whatsoever reason, the amount can be paid only by cash with an additional payment of Rs1,000/- for each cheque / DD dishonoured within 3 days of the date of dishonouring of the cheque/DD, failing which suitable legal action will be initiated by IBOOKS. Such dishonoured cheques will be cancelled in front of the parent/guardian/student and kept at iBOOKS for record purposes. However in case of DDs, the same will be handed over to the student after the cash payment stated here.
Post-dated cheques (which amount to delay in payment), and outstation cheques will be treated as dishonoured cheques. Every such post-dated cheque or outstation cheque, though deposited by chance and received by the staff, will be treated as dishonoured cheque and the outstanding fee along with additional payment of Rs 1,000/- can be paid only by cash within 3 days of the date of dishonouring of the cheque failing which suitable legal action will be initiated by iBOOKS.
Carefully write out the following at the bottom left corner of the back of the cheque/DD such that the cheques/DD will not get dishonoured for reasons of tampering/clarity : (1) Roll No. and Name of the student and (2) Course applied for / Month of the instalment. Ensure to write properly so that the cheque/DD is never dishonoured.
SECTION - IV : Loss OR DAMAGE of Identity Card AND CHANGE OF STREAM or course
An I-Card will be issued to the student. Once it is issued, students without I-Cards, will not be permitted inside the premises. Till such time the student has to use the receipt.
Reissue of I-card, if lost, is permitted on a non-refundable payment of Rs 500/- + Service Tax.
However such reissue is permitted only once. If the I - card is lost or damaged for the second time, no reissue is permissible and that shall amount to violation of clauses of this agreement by the applicant and his parent / guardian.
A stream or course of study (i.e. Engg or Med or Combo or IIT or AIIMS / AFMC or any other STREAM wherever applicable), once opted by a student in writing in his / her Application Form, shall be taken as final and no change is allowed there-after. However in rare cases, if possible, a student may be allowed to change his / her STREAM on payment of STREAM / COURSE CHANGE-OVER FEE of Rs 1,000/-. In addition, the student shall pay the cost of the study materials (of the new Stream/course) supplied at the time of such change-over.
SECTION - V : OTHER TERMS & CONDITIONS
Access of the student and / or his / her parent / guardian to various areas / parts within iBOOKS premises shall be subject to rules and regulations of iBOOKS prescribed from time to time.
The student shall take care of himself / herself and shall remain responsible for his / her safety within the premises of iBOOKS. The applicant and his / her parent / guardian hereby indemnify iBOOKS of any mis-happennings, if anym within or outside the premises of iBOOKS.
The applicant and his / her parent / guardian must not be involved in any illegal or anti-social activity in the past or at anytime during the period in which this document is valid.
The applicant and his / her parent / guardian must take all care to uphold the name, goodwill and brand of iBOOKS and depict a warm relation with iBOOKS in the eyes of the public at all times and at all costs.
Non disclosure of data : The applicant and his / her parent / guardian shall not disclose the data, information, system of study etc gained during the conduct of course including data of students and faculty, if any, to any other person / entity / organisation which is in a similar field as that of any companies of iBOOKS Group of companies, for a period of atleast 12 months from the date of discontinuation of this agreement, caused due to violation of any of the clause of this agreement by the applicant and his / her parent / guardian or otherwise.
In case of difference of opinion : All other related matters of difference of opinion, not stated in this Agreement, would be interpreted as decided by the Chairman of iBOOKS.
The agreement, given herein, is in addition to the agreement(s), if any, signed earlier. In cases of conflict / doubt / confusion between any clause of the agreement, given herein, and other agreement(s), if any, signed on a date prior to the date of signing the agreement, given herein; the agreement, given herein shall take precedence.
The student shall abide by all present & future rules/decisions of iBOOKS which are of academic and administrative in nature.
Disputes and Arbitration: In case of disputes and legal matters related to the course, the functioning of iBOOKS or interpretation of this agreement, or otherwise, the matter shall be referred to a sole arbitrator appointed by Chairman of iBOOKS, before taking such matters to courts.
Such arbitration proceedings shall be held at New Delhi.
No person / authority shall have a right to take any matter to a court/any tribunal without first resorting to arbitration.
Provisions of Indian Arbitration and Conciliation Act 1996 shall be applicable to such arbitration.
All disputes and legal matters related to the course unresolved by the arbitration process, referred to above, if any, shall be subject to the EXCLUSIVE jurisdiction of courts and / or forums located at New Delhi (India) ONLY. This is unconditionally and irrevocably agreed to by both iBOOKS and the applicant & his / her parent / guardian.
In case a need to refer to consumer forum arises then it is irrevocably and unconditionally agreed to refer the matter to the consumer forum at New Delhi alone, irrespective of the applicant or his/her parent/guardian residing at New Delhi.
No other courts or forum or statutory dispute resolution bodies other than the ones situated at New Delhi shall have jurisdiction over the matters / disputes, if any, arising out of this agreement.
Bar against legal proceeding: No court of law and / or tribunal including but not limited to Consumer forum shall be ever approached by the student / parent to take cognizance of anything / matter for any legal action against iBOOKS or any staff or employee or its associated companies without the complainant and/or aggrieved party first having resorted to arbitration as provided vide arbitration clause above and with approval of the Chairman of iBOOKS.
Violations of any of the above mentioned terms & conditions will lead to cancellation of this agreement and will entitle iBOOKS to claim any damages / expenses incurred, if any, due to such violation and subsequent cancellation procedures, from the applicant and / or his / her parent / guardian.
SECTION - VI : UNDERTAKING BY THE APPLICANT AND HIS / HER PARENT / GUARDIAN
I know that this course demands that I purchase a legal copy of the latest edition of the prescribed books/study materials. I promise to comply with this requirement failing which I am liable to be dismissed/debarred from the course.
I request iBOOKS to please issue me the necessary text books for the course opted for by me. I shall pay for the same along with the fees (although it is billed separately)
I request iBOOKS to make payments on my behalf to external parties/entities inlcuding but not limited to organisations like NIOS/CBSE/CHSE/ISCE/Government of India etc. in relation to the course opted for by me. I undertake to pay to iBOOKS all such payments made by iBOOKS, if any, on my behalf to any external agency/party in relation with my course.
I request iBOOKS to allow me to use the address of iBOOKS premise where I am taking admission for providing to external parties / entities inlcuding but not limited to organisations like NIOS / CBSE / CHSE / ISCE / Government of India etc. in relation to the course opted for by me.
I request and authorise iBOOKS to fill up necessary forms on my behalf to facilitate the completion of the course opted for by me.
I/we undertake not to instruct my / our bankers for stop PAYMENT of any of my / our cheques paid to iBooks. If I / we do so, for whatsoever reason, I / we will be legally liable to pay by cash to iBooks the amount of my / our cheques alongwith an additional Rs 5000/- within a period of 3 days of issue of STOP PAYMENT instruction to bank. I know and accept that on my / our failure to do the payment , iBooks is entitled to file a legal suit against me / us to recover the amounts stated above alongwith other incidental compensations, which shall be atleast Rs 20,000/-.
I/we undertake not to refuse to my / our bank / credit card company, any transaction made on our credit / debit card towards payment of the course fee to iBooks, as per the payment option, mode & scheme mentioned & accepted by me here, in this form. I know and accept that on my / our failure to do so, iBooks is entitled to file a legal suit against me / us to recover the amounts stated above alongwith other incidental compensations, which shall be at least Rs 20,000/-.
I am aware that the schemes of IPS and OTP have been made to help us to avail of some discounts and in turn also put restrictions on my options of refund, if I discontinue from the course in between. Opting for EMI / IPS / OTP schemes have been our own personal decision being aware of their pros and cons very well.
Certified that in case of payment of the fees by credit / debit card, the card member will be the person responsible for bearing my / my child’s educational expenses at iBooks.
Certified that the data furnished by me / us on the reverse side of this page are true to the best of my/our knowledge and that the applicant is eligible for the Test for which this coaching course is meant.
Certified that I / we have read carefully, understood the contents, accept and undertake to abide by each and every clause stated above and the other existing rules / regulations of iBooks. Also certified that I / we have kept a photocopy of all pages of this Application Form for my / our future reference.
Certified that I am aware that the courses of iBOOKS provide coaching and hence do not need any affiliation / accreditation / recognition from any university or state / central board.
Certified that I am taking admission after having thoroughly personally verifying and satisfying myself about this course, its validity, effectiveness etc. Hence, I also declare that I shall not hold iBOOKS responsible for any issues/disputes arising out of inadvertent/unintentional ommission or commission by iBOOKS or its staff in this regard.
I/we also know that the fee, once paid either by card or cash or cheque, is/are not refundable under any circumstance including cancellation of studentship of iBooks, if any except in cases of OTP refund as mentioned in this agreement.
I have understood that in case of disputes including but not limited to any disputes in any courts of law,if any, arising out of this agreement and the studentship of the applicant at iBOOKS, the courts and/or tribunals at NEW DELHI ALONE shall have EXCLUSIVE JURISDICTION and shall be approached only after arbitration proceeding, as specified above.
